Participation terms and conditions

TRUMPF Werkzeugmaschinen GmbH + Co. KG (hereinafter referred to as "TRUMPF" or "TW") has organized a prize draw competition ("competition") as part of the customer survey. The following terms and conditions apply exclusively for participation in the competition.

Participation, procedure and end of the competition

All employees of TRUMPF customers located in {Land} ("promotion countries") may participate. The competition will take place as of 01.02.24 and ends as soon as 100 customers have purchased in the new E-Shop.  Prizes are drawn once the promotional period ends. ("date of drawing").

TRUMPF employees, employees of companies affiliated with TRUMPF and competition partners are not allowed to participate.

In order to participate in the prize giveaway, participants must make a purchase in the new E-Shop during the promotional period.

TRUMPF reserves the right to ban certain participants from participating in the competition on legitimate legal grounds. For instance, legitimate legal grounds include violating these participation terms and conditions, manipulating the competition or providing false information. All personal information provided must be truthful in order to participate.

TRUMPF reserves the right to end or temporarily suspend the competition at any time without prior announcement. This applies in particular to circumstances that disrupt or prevent the competition from proceeding according to plan. In the event that participant behavior results in the competition being suspended, TRUMPF reserves the right to demand compensation from the culpable participant. Participation in the competition does not incur any costs beyond the usual Internet connection costs, for example.

Competition

The first 100 ordering customers in the new E-Shop will receive an email if they win. Then, each of the first 100 ordering customers will be sent a MyTRUMPF cup and a MyTRUMPF coaster. The prizes will be mailed to the winners.

Data protection

TRUMPF solely collects, processes and uses personal data provided by participants to conduct the competition. The terms of the TRUMPF privacy notice apply accordingly.

Limitation of liability

Without prejudice to the legal grounds, TRUMPF can only be held liable if damage can be attributed to a culpable breach of a material contractual obligation (cardinal obligation) in a manner that impedes the achievement of the purpose of the contract or is due to intent or gross negligence. In the event that TRUMPF is held liable for violating a material contractual obligation without the involvement of any intent or gross negligence, liability is limited to the extent that TRUMPF could typically expect the incident to occur at the time the contract was concluded based on the facts known at that time. The above limitations or exclusions of liability do not apply in the case of culpable injury to life, limb, or health, for liability claims asserted on the basis of the Product Liability Act, in cases of a contractually agreed assumption of liability regardless of fault, or if the corresponding circumstance underlying the liability claim was fraudulently concealed. In the event that participant behavior results in the competition being suspended, TRUMPF reserves the right to demand compensation from the culpable participant.

Closing provisions

Participants are not legally entitled to the prize. Recourse to the courts is not permitted. Participants are not legally entitled to win. The prize cannot be passed on to other individuals or paid out in cash.
